SubTitle 1. COUNTY ACQUISITION, EXCHANGE, CONVEYANCE, AND CONDEMNATION |
§ 3-9-109. PUBLICATION AND HEARING.
(a)
Exemption. This section does not apply to:
(1)
An exchange or conveyance of property under this subtitle if the exchange or conveyance is expressly approved by the County Council;
(2)
An exchange of property under § 3-9-103(b) or (d) of this subtitle;
(3)
The conveyance of property acquired from the Board of Education as provided under § 3-9-104(a) of this subtitle;
(4)
The conveyance of an easement under § 3-9-108.1(e)(1) of this subtitle to a public service company as defined in § 1-101 of the Public Utility Companies Article of the Annotated Code of Maryland if the value of the easement is less than $25,000;
(5)
The conveyance of an easement under § 3-9-108.1(e)(2) of this subtitle; or
(6)
The leasing of property under § 3-9-110 of this subtitle.
(b)
Publication - Required. A notice of the proposed disposition of property under this subtitle shall be published at the expense of the purchaser once per week for 3 weeks in one or more newspapers of general circulation.
(c)
Same - Contents.
(1)
The notice shall include:
(i)
The terms of the disposition;
(ii)
The compensation to be received for the disposition; and
(iii)
Except as provided in paragraph (2) of this subsection, information about filing objections to the disposition of the property with the County Administrative Officer.
(2)
Paragraph (1)(iii) of this subsection does not apply to:
(i)
The exchange of property under § 3-9-103(c)(2)(ii) of this subtitle; or
(ii)
Subsection (h) of this section.
(d)
Filing objections. The County Administrative Officer shall receive specific written objections to the disposition for 10 days after the last notice publication.
(e)
Hearing - Date. If valid objections are filed with the County Administrative Officer, the County Administrative Officer shall set a date for the hearing of the objections for not later than 45 days after the last notice publication.
(f)
Same - Conduct and decision. The County Administrative Officer shall:
(1)
Conduct the hearing; and
(2)
Issue a decision within 10 days after the hearing.
(g)
County to execute the instrument. If no valid objection is made or the County Administrative Officer determines that no objection should be sustained after the hearing, the county shall execute the appropriate instrument to effect the disposition.
(h)
Additional publication requirement. After a governmental entity has agreed to acquire the property or after public sale, but before transfer of the property, an advertisement of the conveyance shall be published as provided in this section.
