§ 3-9-106. SAME - SURPLUS PROPERTY NOT ELIGIBLE FOR A BUILDING PERMIT.
(a)
In general. If surplus property does not comply with requirements for the issuance of a building permit, consistent with the current zoning on the property, the county shall offer the property to the adjacent property owner or owners.
(b)
Procedure. An adjacent property owner shall execute a contract with the county to acquire the surplus property within 45 days after the adjacent property owner received the county's offer to convey the surplus property.
(c)
Price. The county shall convey the property for a price as provided in § 3-9-105 of this subtitle.
(d)
Failure to execute. If an adjacent property owner does not execute a contract as provided in this section, the county may convey the property:
(1)
By public sale; or
(2)
To a governmental entity:
(i)
For a price as provided in § 3-9-105 of this subtitle; or
(ii)
As provided in § 3-9-108 of this subtitle.
