§ 3-3-101. REMOVAL OF MEMBERS.

  • (a)

    "Scheduled meeting" defined. In this section, "scheduled meeting" means a meeting of the full board, commission, committee, panel, or foundation for which the chairman has given members written notice at least 7 days in advance.

    (b)

    Scope.

    (1)

    This section applies to a board, commission, committee, panel, or foundation established under this title that is not otherwise subject to a provision authorizing the removal of a member because of the member's absence from meetings.

    (2)

    This section does not apply to:

    (i)

    The Planning Board; and

    (ii)

    The Board of Recreation and Parks.

    (c)

    Exception - Does not apply to absence because of illness. This section does not apply to a member's absence that is the result of a prolonged illness that, in the judgment of the County Administrative Officer, should not otherwise permanently interfere with the member's ability to serve the duration of the member's term of appointment or election to a board, commission, committee, panel, or foundation.

    (d)

    Same - Removal for other reasons authorized. Nothing in this section may be construed to prohibit the removal of an elected or appointed member of a board, commission, committee, panel, or foundation established under this title for a reason other than the member's absence from meetings.

    (e)

    Removal by the County Administrative Officer. Except as otherwise provided by law, the County Administrative Officer shall:

    (1)

    Terminate the membership of an elected or appointed member of a board, commission, committee, panel, or foundation who is absent from more than one-third of the scheduled meetings of the board, commission, committee, panel, or foundation within any 12-month period; and

    (2)

    Declare the member's position vacant subject to being filled by another individual appointed in accordance with the provisions of the Code.
