§ 3-2-1203. ZONING COMMISSIONER.

  • (a)

    Composition of the Office of Zoning Commissioner. The Office of Zoning Commissioner shall consist of the Zoning Commissioner and a Deputy Zoning Commissioner.

    (b)

    Appointment of the Commissioner and Deputy. The Zoning Commissioner and the Deputy Zoning Commissioner shall be appointed in accordance with § 522 of the Charter.

    (c)

    Conditions of service. The Zoning Commissioner and Deputy Zoning Commissioner, as holders of the delegated legislative power conferred on them in this subtitle and in Article 32 of the Code:

    (1)

    Are independent officers within the county government, and are within the Department of Planning solely for budgetary purposes;

    (2)

    Shall be appointed solely with regard to their qualifications for the duties of their office;

    (3)

    Shall have the training or experience to qualify them to conduct quasi-judicial hearings on zoning matters and to discharge the other functions conferred on them in this subtitle and in Article 32 of the Code; and

    (4)

    May not hold another appointive or elective public office or position in the county government except as provided in the Code.

    (d)

    Duties.

    (1)

    The Zoning Commissioner shall administer the Office of Zoning Commissioner.

    (2)

    The Deputy Zoning Commissioner shall assist the Zoning Commissioner in the performance of the duties conferred on the Zoning Commissioner in this subtitle and in Article 32 of the Code and, in the event of the absence or the inability of the Zoning Commissioner to act, shall have all the duties and powers of the Zoning Commissioner.
