§ 35-5-215. VIOLATIONS AND PENALTIES.

  • (a)

    Penalties.

    (1)

    A property owner who violates a provision of this subtitle is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $500 for each day that the violation exists or imprisonment not exceeding 90 days or both.

    (2)

    A penalty ordered under this subtitle is in addition to and not a substitute for any other penalty authorized under a federal, state, or local law.

    (b)

    Violation by tenant or landlord. A court may consider a violation of this subtitle by a tenant or landlord as evidence of a breach of the lease agreement between the tenant and landlord.
