§ 34-3-103. USE OF WATERTIGHT BOXES.
(a)
Authorized. Section 34-3-102 of this title may not be construed to prevent the use of watertight boxes or other watertight receptacles in privies, water closets, and outhouses.
(b)
Conditions.
(1)
A watertight box or other receptacle shall be emptied by the occupant.
(2)
The party occupying premises with a watertight box or receptacle shall have it emptied in a timely manner in order to prevent:
(i)
Surface overflows of sewage waste; or
(ii)
Sewage backups in premises.
(c)
Penalty. An owner who does not have a watertight box or receptacle emptied on notice from the county or the Director of Environmental Protection and Sustainability is guilty of a misdemeanor and on conviction is subject to a fine of $1,000.
