§ 34-1-101. HYDROGEOLOGICAL STUDIES WITHIN WATERSHEDS; SUBDIVISION APPLICATIONS; STUDIES AND REPORTS.

  • (a)

    Director may require. The Director of Environmental Protection and Sustainability may require an applicant for the subdivision of any land to conduct hydrogeological studies in connection with the subdivision of any land within the county.

    (b)

    Environmental effects report. The applicant shall file an environmental effects report with each application for the subdivision of any land, which subdivision has potential to impact surface waters or groundwater.

    (c)

    Director to establish guidelines. The Director shall establish the guidelines, criteria, standards, or policy concerning the contents and requirements of the hydrogeological studies and environmental effects report required under this section reasonably necessary to the environmental protection of the watersheds of county water supply reservoirs and the public safety, health, and welfare.

    (d)

    Director may disapprove subdivision. The Director may disapprove any subdivision if, in the Director's judgment, the hydrogeological studies, environmental effects report, or both show that disapproval is required in the interest of the protection of watersheds and the public health, safety, and welfare.
