§ 33-4-115. PENALTIES.

  • (a)

    Criminal. A person who violates any provision of this title is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 for each violation.

    (b)

    Civil.

    (1)

    As an alternative to a criminal action, the county may bring a civil action against any person for any violation of this title.

    (2)

    The action may seek the imposition of a civil penalty of not more than $5,000 against the person, an injunction to prohibit the person from continuing the violation, or both.

    (c)

    Continuing violation as separate offense. Each day that a violation continues constitutes a separate offense.

    (d)

    Enforcement. The Director of Environmental Protection and Sustainability may enforce the provisions of this title in accordance with Article 3, Title 6 of the Code.
