§ 33-2-902. CIVIL PENALTIES.

  • In assessing an appropriate civil penalty under this title, the Director shall give due consideration to:

    (1)

    The size of the business of the person charged;

    (2)

    The gravity of the violation;

    (3)

    The good faith of the person charged; and

    (4)

    The person's history of previous violations.
