§ 33-2-702. EROSION AND SEDIMENT CONTROL PLAN.

  • (a)

    Required for certain timber harvests. An Erosion and Sediment Control Plan under § 33-5-104 of this article is required for all tree harvesting, including harvesting on agricultural land, that would disturb more than 5,000 square feet of surface area in one year.

    (b)

    Forest management plan. If the Erosion and Sediment Control Plan affects a total of more than one acre of forest or developed woodland, the plan shall be accompanied by a Forest Management Plan approved by the Department of Environmental Protection and Sustainability, the forestry programs of the State Department of Natural Resources, and the County Forest Conservancy District Board.

    (c)

    Approval. An Erosion and Sediment Control Plan shall be submitted and approved under § 33-5-104 of this article.
