§ 32-5-104. PROHIBITIONS.

  • (a)

    Limitations on the powers of authority. An authority established under this title may not:

    (1)

    Exercise the power of eminent domain;

    (2)

    Purchase, sell, construct, or, as a landlord, lease office or retail space;

    (3)

    Except as otherwise authorized by state law, engage in competition with the private sector; or

    (4)

    Bind the county as a party in any contract.

    (b)

    County liability.

    (1)

    An authority or a member of an authority, may not incur any financial liability in the name of the county.

    (2)

    The county may not be held liable for any obligation or liability incurred by the authority resulting from activities undertaken under this title.
