§ 32-4-306. COMPLETION OF PUBLIC IMPROVEMENTS.
(a)
Issuance of use and occupancy permit. The county may not issue a use and occupancy permit unless there is:
(1)
Base course paving that has been approved by the Department of Public Works; or
(2)
Good cause shown in accordance with the conditions imposed by the Department of Permits, Approvals and Inspections with the approval of the Department of Public Works.
(b)
Additional performance security. Before the issuance of a use and occupancy permit, the county may require the applicant to post additional performance security for public improvements required in the environmental, right-of-way improvement and utility agreements in the event of increased cost of the public improvements.
