§ 32-4-302. SCOPE OF OBLIGATIONS; IMPROVEMENTS.

  • (a)

    Required. An applicant shall provide the pubic improvements or private improvements required by the county.

    (b)

    Cost. Except as provided under § 32-4-303 of this subtitle, an applicant shall be responsible for the cost of the improvements.

    (c)

    Conveyance to county of the improvement.

    (1)

    The applicant shall prepare, execute, and deliver to the county those instruments, in a form approved by the Office of Law, required to convey to the county all rights-of-way that are determined to be necessary and appropriate for the county to accept and maintain the public improvements.

    (2)

    The rights-of-way shall be conveyed in:

    (i)

    Fee simple;

    (ii)

    Easement; or

    (iii)

    Any other form or interest approved by the county.

    (3)

    The nature of the conveyance shall be established by the county.

    (4)

    Upon acceptance by the Office of Law of the instruments, the county shall record the instruments in the land records of the county.
