§ 32-3-512. PETITIONS WITH DOCUMENTED SITE PLAN.

  • (a)

    General requirements. If a zoning reclassification petition includes documentation relating to the proposed use of the property under petition, that documentation must include:

    (1)

    Elevation drawings and a plan:

    (i)

    Satisfying the Zoning Commissioner's rules of practice and procedure; and

    (ii)

    Showing locations, coverage, floor areas, heights, character, and exterior materials of all proposed structures and all existing structures to be retained;

    (2)

    All existing structures to be removed;

    (3)

    Signs visible outdoors;

    (4)

    All principal uses;

    (5)

    Hours of operation, maximum number of employees, and maximum levels of emanations including sound and other vibrations, dust, odors, gases, light, and heat;

    (6)

    Parking and loading facilities;

    (7)

    Existing and proposed public and quasi-public facilities on and adjacent to the site, including storm-drain systems, waterlines, sewerage, streets and drives, and railroad sidings;

    (8)

    Existing ponds and other bodies of water, watercourses, riverine floodplains, major vegetation, and unusual natural formations and proposed changes with respect to any of these features;

    (9)

    Screening and landscaping;

    (10)

    Existing topography and proposed major changes in grade; and

    (11)

    An environmental impact statement, as defined in the Baltimore County Zoning Regulations, that:

    (i)

    Concerns the proposed use of the property; and

    (ii)

    Has been competently prepared by a professional planner or engineer of appropriate qualifications.

    (b)

    Exceptions.

    (1)

    In this subsection, "building envelope" means a clearly delimited area within which a building is to be entirely located, but which is larger than the area covered by the building itself.

    (2)

    A plan submitted under this section may:

    (i)

    Show the location of a precise building envelope in lieu of the precise location of a building;

    (ii)

    Show precise maxima and minima in lieu of fixed values;

    (iii)

    Set forth lists of precisely described possible uses of a given space, in lieu of specifying a single use; and

    (iv)

    Otherwise reasonably allow for flexibility or alternatives, provided that appropriate precise limits are set forth.
