§ 32-3-221. PUBLIC HEARING REQUIRED.

  • (a)

    In general. After the County Council has received a final report of the Planning Board recommending adoption of zoning regulations or the zoning map, the County Council shall hold one or more public hearings on the regulations or map.

    (b)

    Duty to publish notice and make materials available. Before holding a hearing required under subsection (a) of this section, the County Council shall:

    (1)

    Provide notice in a newspaper of general circulation in the county at least 10 business days before the hearing; and

    (2)

    For 10 business days make available for inspection at the Department of Planning, in each respective councilmanic district, and at any other public place the County Council designates for public inspection:

    (i)

    The final report of the Planning Board;

    (ii)

    A graphic representation of the issue in a manner determined by the Director of Planning;

    (iii)

    Any supporting exhibits; and

    (iv)

    Any minority report and maps from a dissenting member of the Planning Board.

    (c)

    Adoption of zoning map and regulations.

    (1)

    After the expiration of the notice period and following the public hearings, the County Council may adopt the zoning regulations or zoning map, subject to any changes or amendments as the County Council considers appropriate.

    (2)

    The Director of Planning shall make appropriate arrangements for the signature of the Chairman of the County Council attesting to the correctness of the zoning map.
