§ 32-3-202. PREPARATION OF ZONING REGULATIONS AND MAPS; AMENDMENTS.

  • (a)

    Planning Board; recommendation of zoning regulations and map. The Planning Board may recommend to the County Council for adoption:

    (1)

    Zoning regulations and amendments to the zoning regulations; and

    (2)

    A zoning map that shows the boundaries of the proposed districts, divisions, or zones into which the county is recommended to be divided in accordance with this title.

    (b)

    Same; amendments and review of regulations and map. The Planning Board may:

    (1)

    With prior approval by the County Council, review the existing zoning map or a portion of the map within the URDL as designated by the County Council; and

    (2)

    Recommend to the County Council comprehensive revisions to the zoning map:

    (i)

    As the Planning Board may consider advisable in the light of changed conditions; or

    (ii)

    Whenever the Planning Board recommends revisions or updates to the Master Plan under Title 2, Subtitle 2 of this article and § 523 of the Charter.

    (c)

    Amendments.

    (1)

    A legally adopted zoning map shall remain in effect until the County Council adopts a map in substitution of the original map or the map is amended in accordance with this title.

    (2)

    Except as provided in paragraph (3) of this subsection, the County Council shall adopt amendments to the zoning regulations and make comprehensive revisions of the zoning map in accordance with the same procedure specified for the original adoption of the zoning regulations and map.

    (3)

    After receipt of recommendations from the Planning Board and in accordance with this subtitle, the County Council may amend at any time the official zoning map in designated portions of the county in conjunction with revisions or updates to the Master Plan.

    (d)

    Zoning geodatabase.

    (1)

    The county shall create and retain the zoning map as a zoning geodatabase, which is an electronic database representing the geographic features and attributes of the zoning lines and zoning districts.

    (2)

    The zoning geodatabase shall be used to depict the zoning lines and zoning districts map in electronic and printed formats.

    (3)

    The zoning geodatabase shall store additional properties, which would describe the zoning map features history and relationship to other data sources.
