§ 32-3-201. DIVISION OF COUNTY INTO ZONES; UNIFORMITY OF REGULATIONS.

  • (a)

    In general.

    (1)

    In order to achieve the purposes established under § 32-3-101 of this title, the county shall be divided into districts, divisions, or zones.

    (2)

    The number, shape, and area of the districts, divisions or zones shall be best suited to carry out the purposes of this title.

    (3)

    Within a district, division, or zone, the erection, construction, reconstruction, alteration, repair, and use of buildings, structures, and land may be regulated.

    (b)

    Uniform regulations.

    (1)

    The county shall adopt regulations that are uniform for each class or kind of building or structure throughout each district, division, or zone.

    (2)

    Notwithstanding paragraph (1) of this subsection, the regulations in one district, division, or zone may differ from those in other districts, divisions, or zones.

    (c)

    Overlay of a district.

    (1)

    For the purposes of this title, the overlay of a district onto one or more zones or other districts shall be regarded as if a new zone had been established encompassing the area covered by the district.

    (2)

    The overlay district shall be governed by the zone regulations, except if the zone regulations are enlarged, modified, or limited by the district regulations.
