§ 25-3-204. SUBSCRIBER NOTIFICATIONS.

  • (a)

    Notification provided at installation.

    (1)

    A franchisee shall provide to subscribers information regarding:

    (i)

    Products and services offered;

    (ii)

    Prices and options for programming service and conditions of subscription to programming and other services;

    (iii)

    Installation and service maintenance policies;

    (iv)

    Instructions on how to use the cable service;

    (v)

    Channel positions of programming carried on the system; and

    (vi)

    Billing and complaint procedures, including the address and telephone number of the local franchising authority's office.

    (2)

    The franchisee shall provide the information required under paragraph (1) of this subsection in writing, at the time of installation, at least annually, and at any time on request.

    (b)

    Notification of changes.

    (1)

    (i)

    As soon as possible, a franchisee shall notify subscribers of any changes in rates, programming services, or channel positions through announcements in writing.

    (ii)

    If the change is within the control of the franchisee, the franchisee shall notify subscribers not less than 30 days in advance of the changes.

    (2)

    A franchisee shall notify subscribers of any significant changes in the information required under subsection (a)(1) of this section at least 30 days in advance of the change.

    (3)

    A franchisee is not required to provide prior notice of a rate change that is the result of a regulatory fee, franchise fee, or any other fee, tax, assessment, or charge imposed by a federal agency, the state, or the county on transactions between a franchisee and its subscribers.
