§ 25-2-106. MODIFICATION OF A FRANCHISE AGREEMENT.

(a)

Authorized. A franchisee may submit an application to the County Council for a modification of the franchise agreement.

(b)

Application. An application for modification of a franchise agreement shall include:

(1)

The specific modification requested;

(2)

The justification for the requested modification, including the impact of the requested modification on:

(i)

Subscribers and others; and

(ii)

The applicant, if the modification is not approved;

(3)

A statement of whether the modification is sought in accordance with § 625 of the Federal Communications Act of 1934, and, if so, a demonstration that the requested modification meets the legal standards imposed under the act; and

(4)

Any other information necessary for the County Council to make a determination.
