§ 23-2-101. MOTOR FUEL SIGNS INDICATING PRICES.
(a)
Statement of purpose.
(1)
The county council finds that the regulation of signs advertising prices of motor vehicle fuels at places dispensing fuels at retail in the county will serve to protect the safety and recreational value of public travel on highways in the county and will better protect the public investment in its streets and highways.
(2)
This section is enacted in furtherance of the purposes stated in paragraph (1) of this subsection.
(b)
Duty of retail dealers of motor fuel.
(1)
A retail dealer in motor fuel shall publicly display on each motor fuel pump or dispensing device from which motor fuel is sold at least one but not more than two signs not larger than 80 square inches that displays:
(i)
The price per gallon of the motor fuel;
(ii)
The state and federal taxes;
(iii)
The total price sold from the motor fuel pump or device; and
(iv)
An itemization of the cost per gallon of the motor fuel, the amount of federal taxes, and the amount of state taxes.
(2)
Except for the figures and fractions used in the price-computing mechanism of the motor fuel pump or dispensing device, motor fuel signs shall display in the same size all figures, including fractions.
(c)
Prohibition. Except for signs required under subsection (b) of this section, a person may not post or display within the view of a public highway a sign located on or about the premises where retail motor fuel is sold that states or relates to the price of motor fuel.
(d)
Penalty. A person who violates this section is guilty of a misdemeanor.
