§ 21-21-101. DEFINITIONS.

  • (a)

    In general. In this title the following terms have the meanings indicated.

    (b)

    Junk or scrap metal. "Junk" or "scrap metal" has the meaning stated in § 17-1001 of the Business Regulation Article of the Annotated Code of Maryland.

    (c)

    Junk dealer or scrap metal processor.

    (1)

    "Junk dealer" or "scrap metal processor" has the meaning stated in § 17-1001 of the Business Regulation Article of the Annotated Code of Maryland.

    (2)

    "Junk dealer" or "scrap metal processor" does not include:

    (i)

    A landfill or solid-waste facility that is operated privately or by a governmental entity or an instrumentality or unit of a governmental entity;

    (ii)

    An automotive dismantler and recycler licensed under Title 15, Subtitle 5 of the Transportation Article of the Annotated Code of Maryland or scrap metal processor that only acquires whole vehicles for the purpose of dismantling, destroying, or scrapping them for the benefit of their parts or the materials in them; or

    (iii)

    A person that buys junk or scrap metal to use as raw material to produce not less than 1,000,000 tons of steel in the county per calendar year.

    (d)

    Person.

    (1)

    "Person" means any individual, corporation, partnership, joint venture, firm, association, or other entity.

    (2)

    "Person" does not include, unless otherwise expressly provided, a governmental entity or an instrumentality or unit of a governmental entity.
