§ 21-16-119. SAME - DELIVERY TO STORAGE FACILITY; REPOSSESSION BY OWNER.
If a vehicle is towed or otherwise removed from a parking lot or garage, the person in possession of the vehicle:
(1)
Shall immediately deliver the vehicle directly to a storage facility customarily used by the person undertaking the towing or removal of the vehicle;
(2)
Shall provide a brightly lit storage location;
(3)
Shall provide the owner of the vehicle immediate and continuous (24 hours per day, 7 days per week) opportunity, from the time the vehicle was received at the storage facility, to retake possession of the vehicle, but in no event later than thirty minutes after having been contacted by the owner of the vehicle;
(4)
If the motor vehicle is towed without the consent of the owner, storage charges may not commence before 12 hours after the motor vehicle is in fact available for recovery by the owner; and
(5)
Shall accept cash, or traveler's checks (accompanied by reasonable identification) as payment for approved fees.
