§ 21-16-112. POLICE INIATED TOWING - PROCEDURE FOR REQUESTING TOWING SERVICES.

  • (a)

    Chief and contractor to retain list of licensees . The Chief of Police and the contractor shall retain a current list of all police-initiated towing licensees.

    (b)

    Owner may request a specific tower .

    (1)

    The owner of a vehicle requiring police-initiated towing may request that a specific licensed police-initiated towing company respond to a call to tow the vehicle if the towing company can respond within a reasonable time.

    (2)

    If the vehicle is a traffic hazard or is obstructing traffic and the company requested by the owner of the vehicle cannot respond within 15 minutes, the contractor shall call the assigned licensed police-initiated towing company and the owner of the vehicle shall be subject to the fees authorized under this title.

    (c)

    Procedure . Subject to subsection (b) of this section, if, in the judgment of the responding police officer, police-initiated towing is required, the Police Department shall contact the contractor who shall contact the licensed police-initiated towing operator whose place of business is assigned to the location from which a vehicle is to be towed.

    (d)

    Person in charge at the scene . Except as otherwise provided by law, at all times, the scene and any police-initiated towing operator at the scene shall be under the command of the Chief of Police or the Chief's designee or the highest ranking police officer at the scene.
