§ 21-12-304. SEIZURE.

  • (a)

    Authority in general. A county police officer may seize any minibike subject to forfeiture without warrant if:

    (1)

    The police officer has probable cause to believe the minibike is subject to forfeiture; and

    (2)

    A warrant is not constitutionally required.

    (b)

    Impoundment. When a minibike is seized under the provisions of this subtitle, the county police officer who seized it may cause it to be removed to a place designated by the county Chief of Police.

    (c)

    Not repleivable. A minibike seized under this subtitle is not repleivable but shall be deemed to be in the custody of the person who seized it subject only to the orders and decrees of the court or the official having jurisdiction over it.
