§ 20-5-112. SPECIFIC DISCHARGE STANDARDS.

  • (a)

    The Engineer shall establish specific discharge standards specifying quantities or concentrations of pollutants or pollutant properties which may be discharged or introduced into the system. Such specific discharge standards may be more stringent than the national pretreatment standards or state standards, if any. All such specific discharge standards established by the Engineer as well as any applicable national pretreatment standard and state standard shall be deemed to be a part of and included in each industrial wastewater discharge permit issued under § 20-5-116 of this title.

    (b)

    No person shall discharge any wastewater or pollutant containing substances in excess of the maximum permissible concentration established by such person's discharge permit. The discharge standards contained in a discharge permit shall be the most stringent of either a national standard, a state standard, or a local standard.

    (c)

    At such time as a national categorical pretreatment standard for a particular industrial subcategory becomes effective, the national pretreatment standard, if more stringent than the specific discharge standard established by the Engineer, shall immediately supersede the standard established by the Engineer.

    (d)

    Any state standard, requirement, or limitation on discharges shall apply in any case where the state standard is more stringent than the national standard and the standard established by the Engineer pursuant to this section.

    (e)

    The Engineer shall have the right and authority to modify a specific discharge standard at any time and to apply such standard to both new and previously issued permits.
