§ 20-5-102. DEFINITIONS.
(a)
In this title, the following abbreviations have the meanings indicated:
CFR means the Code of Federal Regulations.
GPD means gallons per day.
ppm means parts per million.
(b)
In this title, the following terms have the meanings indicated:
ACT; THE ACT means the Federal Water Pollution Control Act, also known as the Clean Water Act, as amended (33 U.S.C. sec. 1251 et seq.).
APPROVAL AUTHORITY means the secretary of the environmental health administration of the state or administrator of the EPA if there is no approved state pretreatment program.
AUTHORIZED REPRESENTATIVE OF INDUSTRIAL USER means an authorized representative of an industrial user, including but not limited to:
(1)
An officer of at least the level of vice-president, if the industrial user is a corporation;
(2)
A general partner or proprietor if the industrial user is a partnership or proprietorship, respectively; or
(3)
An individual designated by an authorized representative or by an industrial user as responsible for the overall operation of the facilities from which the effluent originates.
BIOCHEMICAL OXYGEN DEMAND (BOD) means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure, five (5) days at twenty (20) degrees Celsius expressed in terms of weight and concentration as milligrams per liter (mg/l) in accordance with procedures given in standard methods.
BUILDING SEWER means the private portion of the sewer conveying wastewater from the premises of a user to the system.
CHEMICAL OXYGEN DEMAND (COD) means the quantity of oxygen, expressed in milligrams per liter (mg/l), utilized in the chemical oxidation of organic matter in accordance with procedures given in standard methods.
CITY means the City of Baltimore or the Mayor and City Council of Baltimore.
COOLING WATER means the water discharged from any use, such as air conditioning, cooling, or refrigeration, to which the only pollutant added is heat.
COUNTY means Baltimore County, Maryland.
COMPATIBLE POLLUTANTS means biochemical oxygen demand, total suspended solids, pH, and fecal coliform bacteria and any additional pollutants identified in the NPDES permit issued for the system, operated by the city and the county and provided that the system is designed to either treat or remove these pollutants and does actually treat or remove these pollutants to the degree required by the system's NPDES permit.
CONTROL AUTHORITY means the approval authority or the Engineer if the county has an approved pretreatment program under the provisions of the act and regulations issued pursuant thereto.
DIRECT DISCHARGE means the discharge of treated or untreated wastewater directly to the waters of the state.
DISCHARGE STANDARD means a numeric limit relating to concentration, placed on any specific pollutant to control or reduce the quantity discharged to the system. It includes categorical and national categorical pretreatment standards promulgated by the EPA.
ENGINEER means the Director of Public Works or his designated representative.
ENVIRONMENTAL PROTECTION AGENCY (EPA) means the U.S. Environmental Protection Agency or where appropriate the administrator or other duly authorized official of that agency.
FREE-FLOATING OIL means the oil which can be removed in adequate facilities by gravity separation.
GARBAGE means the solid waste resulting from the domestic or commercial handling, preparation, storage, sale, cooking, or dispensing of food.
GRAB SAMPLE means a sample which is taken from a waste stream on a one-time basis without regard to the flow in the waste stream and without consideration of time.
GREASE means fats, greases, or oils of an animal or vegetable nature extractable from wastewater in accordance with standard methods.
HOLDING TANK WASTE means any waste from holding tanks such as vessels, chemical toilets, campers, trailers, septic tanks, and vacuum-pump tank trucks.
INDIRECT DISCHARGE means the discharge or the introduction of water-carried pollutants from any source into the system, including but not limited to holding tank waste discharged into the system.
INDUSTRIAL WASTEWATER means water-carried solid, liquid, or gaseous wastes or a combination thereof resulting from any process of industry, manufacturing, trade, or business or from the development or recovery of any natural resource.
LOCAL means the city or county.
MANHOLE means a structure designed to provide access to the sewer or drain for purposes of examination, cleaning, or sampling.
MG/L means milligrams per liter, sometimes referred to as "parts per million" (ppm).
NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT means a permit issued pursuant to the act and regulations issued pursuant thereto.
NORMAL DOMESTIC WASTEWATER means any wastewater that is discharged from a residential unit which is used primarily for the protection, habitation, and residence of humans.
PERSON means any individual, partnership, copartnership, firm, company, corporation, association, joint stock company, trust, estate, government entity, or any other legal entity or their legal representative, agents, or assigns.
pH means logarithm (base 10) of the reciprocal of the concentration of hydrogen ions expressed in moles per liter of solution.
PLANT means that portion of the system designed to provide treatment to wastewater.
POLLUTANT means any dredged spoil, solid waste, incinerator residue, sewage, garbage, sewage sludge, munitions, chemical wastes, biological materials, radioactive materials, heat, wrecked or discharged equipment, rock, sand, cellar dirt, and industrial, municipal, and agricultural waste discharged into the system or the waters of the state.
POLLUTION means the man-made or man-induced alteration of the chemical, physical, or biological properties of water, including change in temperature, taste, color, turbidity, or odor.
PRETREATMENT or TREATMENT means the reduction of the amount of pollutants, the elimination of pollutants, or the attenuation of the nature of pollutant properties in wastewater to a less harmful state prior to or in lieu of discharging or otherwise introducing these pollutants into the system. The reduction or alteration may be accomplished by any means except as prohibited by federal, state, or local law.
PRETREATMENT REQUIREMENTS means any substantive or procedural requirements related to pretreatment of pollutants imposed on an industrial user, including discharge standards.
SANITARY SEWER means a drain or sewer which is designed to specifically carry sanitary wastewater or a mixture of sanitary and industrial wastewaters.
SANITARY WASTEWATER means a combination of water-carried wastes discharging from the sanitary conveniences of dwellings, including apartment houses and hotels, business buildings, institutions, and industrial establishments which are free from stormwater, surface water, and industrial wastes.
SIGNIFICANT USER means any user of the system who:
(1)
Discharges at least twenty-five thousand (25,000) gallons of wastewater per average work day;
(2)
Discharges an annual average daily flow greater than five (5) percent of the total annual average daily flow of the wastewater received at the plant;
(3)
Discharges toxic pollutants; or
(4)
Is found by the county, state, city or the U.S. Environmental Protection Agency (EPA) to have a significant impact on the system's plant, the quality of sludge, the system's effluent quality, or air emission quality, either alone or in combination with other contributing users.
SLUG means a discharge of sanitary or industrial wastewater having a concentration of any constituent sufficiently above the average and for a period of time which is determined by the Engineer as harmful to the system.
STANDARD INDUSTRIAL CLASSIFICATION (SIC) means a classification pursuant to the Standard Industrial Classification Manual issued by the Executive Office of the President, Office of Management and Budget, 1972, as amended from time to time.
STATE means State of Maryland.
STANDARD METHODS means the laboratory procedures set forth in the latest edition of "Standard Methods for the Examination of Water and Wastewater," published by the American Public Health Association, the American Water Works Association, and the Water Pollution Control Federation.
STORMWATER means any flow occurring during or following any form of natural precipitation and resulting therefrom.
SYSTEM means any and all devices, appurtenances, and equipment used or intended for use in the storage, treatment, recycling, and reclamation of normal domestic or industrial wastewater. The term includes devices, equipment, methods, and systems used or designed to recycle or reuse wastewater, including but not limited to intercepting sewers, outfall sewers, sewage collection systems, pumping, power, and other equipment, and their appurtenances, extensions, improvements, remodelings, additions, and alterations thereof; elements useful in providing a reliable recycled supply such as standby treatment units and clear well facilities; and any works, including the land, that will be an integral part of the treatment process (including land used for the storage of treated wastewater in land treatment systems prior to land application) or land that will be used for ultimate disposal of residues resulting from such treatment. The term also includes devices, equipment, methods, and systems used or designed for preventing, abating, reducing, storing, treating, separating, or disposing of wastewater, including stormwater runoff, or industrial wastewater, including waste in combined stormwater and sanitary sewer systems; and any devices and equipment that convey wastewaters to the system from persons outside the county who are, by contract or agreement with the county, users of the county's system.
TOTAL SUSPENDED SOLIDS (TSS) means the total suspended matter that floats on the surface of or is suspended in water, wastewater, or other liquids and which is removable by laboratory filtering and which is determined in accordance with procedures given in standard methods.
TOXIC POLLUTANT means any pollutant, whether gaseous, liquid, or solid, which when discharged to the system may tend to interfere with any wastewater treatment process or which constitutes a hazard to humans or animals.
USER means any person who discharges, causes, or permits the discharge of wastewater into the system.
USER CHARGE means the total of all wastewater rates, charges, and surcharges which are charged for the use of the system and the treatment of wastewater.
WASTEWATER includes normal domestic, sanitary, and industrial wastewater, together with any groundwater, surface water, and stormwater which enters the system.
WASTEHAULER means any person who transports, hauls, or conveys wastewater for either direct or indirect discharge into the system.
WATERS OF THE STATE means all waters of the state included in the definition contained in Ann. Code of Md., Natural Resources article, 8-101(g).
