§ 20-3-207. CREATION, ASSESSMENT AND COLLECTION OF WATER SERVICE CHARGES FOR THE PHOENIX COMMUNITY WATER SUPPLY.
(a)
There is hereby created a Phoenix Community Water Supply System to furnish water to residents of Phoenix residing along Sunnybrook Road between Paper Mill Road and Merrymans Mill Road in the 10th election district of the county, and shown and described on the Bureau of Engineering Drawings No. 92-0920 through 92-0926.
(b)
Property owners who subsequently develop their property along the aforesaid described Sunnybrook Road shall pay for the installation costs for connection to their property and shall pay a water system connection charge.
(c)
All properties served by this water supply system shall pay an annual benefit assessment in accordance with §§ 20-3-201 and 20-3-202 of this subtitle; however, the levy of these charges shall be deferred for those property owners who have been provided service connections as part of the initial construction of this system. The deferral of the benefit assessment shall terminate when the property is sold or if additional connections to the system should occur.
(d)
The charges for water services furnished by the Phoenix Community Water System shall be billed and collected by the Director of Budget and Finance. All bills shall be paid within thirty (30) days after they have been submitted, and on not less than twenty (20) days written notice of default in such payment and of the consequences thereof, the Director of Budget and Finance shall have the right to direct that the supply be cut off by the Department of Public Works. All bills in arrears may be deemed a sufficient reason for the discontinuance of water service until all arrearages plus a penalty of ten (10) percent of the unpaid bill are paid. If the arrearage and penalties are unpaid, they may be added to the next bill rendered to the resident in question. The addition of such arrearages and penalties to any bill shall not affect the rights of the Director of Budget and Finance to direct that the water supply to such resident be cut off by the Department of Public Works. Whenever the water supply is shut off for nonpayment of water service charges and penalties, all arrearages, penalties and a fee of twenty-five dollars ($25.00) for turning on the water shall be paid to the Director of Budget and Finance before the water supply shall be turned on again. The County Administrative Officer shall assess and fix water rates for the Phoenix Community Water System.
