Title 2. DISPOSITION OF UNCLAIMED PROPERTY |
§ 19-2-103. DISPOSITION OF PROCEEDS.
(a)
Payment of expenses. The Department shall use the proceeds of any public auction sale held under this title to pay, in the following order:
(1)
All expenses of sale;
(2)
All storage and repair charges that may have been incurred by the Department in the safekeeping and custodianship of the property sold;
(3)
Valid liens in the order of their priority; and
(4)
Other lawful charges.
(b)
Balance to the Director of Budget and Finance.
(1)
Not more than 30 days after the date of sale, the Department shall account for and pay over to the Director of Budget and Finance the remaining balance of the money received in the sale.
(2)
The Director of Budget and Finance shall credit funds received from the Department to the general fund of the county.
(c)
Claims - Authority to present. An owner of property sold under this title or any person having a valid claim to property by way of lien that was sold under this title may present a claim to the Director of Budget and Finance for a sum not exceeding the amount received by the director from the Department.
(d)
Same - Director to pay claim. The Director shall pay a claim from the general fund if the claimant can prove the claimant's claim to the money.
(e)
Same - Barred after 1 year. At the expiration of 1 year after the date of sale of any property by the Department, all claims of every person are forever barred.
(f)
Limitation on Department responsibility. This section does not require the Department to make expenditures for any expenses or claims in excess of the amount received from the proceeds of any sale under this title.
