§ 18-2-101. ADOPTION OF ORDERS AND REGULATIONS.

  • (a)

    Authority in general. The county may issue and adopt reasonable orders and regulations to regulate, restrict, or limit the parking or movement of vehicles on a public highway of the county:

    (1)

    For the safety and convenience of the public;

    (2)

    For keeping the roads and highways in the county from becoming congested by vehicles; and

    (3)

    To allow the free and unobstructed use of the roads and highways.

    (b)

    Force and effect of law. Orders and regulations issued and adopted under this section have the force and effect of law.

    (c)

    Signs and records. After the issuance or adoption of an order or regulation, the county shall:

    (1)

    Place and thereafter maintain in conspicuous places along roads or highways signs or markers appropriately describing the orders and regulations applicable to the particular road or highway; and

    (2)

    Maintain a separate journal containing all orders and regulations issued and adopted in accordance with this section, which shall at all times be open to inspection and examination by the public.

    (d)

    Special regulations for public events. If a public fair, game, parade, or other public event is being held in the county and a large gathering of people or vehicles along any road, street, or highway is anticipated, the county may issue reasonable orders governing the traffic and the movement of vehicles in the vicinity of the public fair, game, parade, or other public event, which the county considers necessary to:

    (1)

    Prevent the congestion of traffic and the obstruction of streets, roads, or highways; and

    (2)

    Provide for the safety of pedestrians and event participants.

    (e)

    Signs prima facie evidence. The presence along a highway, road, or street of the signs or markers required by this section is prima facie evidence of the issuance or adoption of orders or regulations under this section.

    (f)

    Penalty. A person who violates an order or regulation issued or adopted under this section is subject to the penalties prescribed in Subtitle 7 of this title.
