§ 17-1-113. TATTOOING OR BODY PIERCING OF MINORS.

  • (a)

    Definitions.

    (1)

    In this section the following words have the meanings indicated.

    (2)

    "Body piercing" means any process that involves piercing or entering the skin or mucous membrane of an individual for the purpose of inserting jewelry or other forms of body decoration.

    (3)

    "Tattoo" means a method of placing an indelible mark or figure on an individual by insertion of pigment under the skin or by the production of scars.

    (b)

    Prohibition. A person may not tattoo or perform body piercing on a minor without the written consent of the minor's parent or legal guardian.

    (c)

    Penalty. A person who violates this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $500 or imprisonment not exceeding 90 days or both.
