§ 13-4-301. PERMIT FOR PROCESSING AND DISPOSAL SITES - REQUIRED.

  • (a)

    In general. A solid waste processing facility or site or land disposal site, may not be established or operated without a permit having first been issued by the Department of Permits, Approvals and Inspections after approval of and being subject to the regulations and requirements of:

    (1)

    The Department of Planning;

    (2)

    The Department of Public Works;

    (3)

    The Fire Department; and

    (4)

    The Department of Environmental Protection and Sustainability.

    (b)

    When state approval required. If the applicant is required to obtain a separate permit from the State Department of the Environment, the county may not issue its approval until the state permit is obtained.

    (c)

    Multiple permits.

    (1)

    Nothing in this subtitle requires a solid waste processing facility or site to obtain more than one permit from the county.

    (2)

    If a facility or site involves activities that would require other permits or approvals under this subtitle, the Department of Environmental Protection and Sustainability shall consolidate all permit or approval processes and its review of the processes into one application.
