§ 13-4-209. COMMERCIAL, INDUSTRIAL, INSTITUTIONAL ESTABLISHMENTS.

  • (a)

    Requirement for private solid waste collection. If the Department of Public Works does not provide solid waste collection and disposal services or provides insufficient solid waste collection and disposal services, the approving authority shall require commercial, industrial, or institutional establishments to provide for the collection and disposal of all their own solid waste at the expense of the owner, tenant, or operator of the commercial, industrial, or institutional establishment and in the manner prescribed in this subtitle.

    (b)

    Prevention of odors. The owner, tenant, or operator of a commercial, industrial, or institutional establishment shall ensure that provisions are made to prevent odors from their solid waste from escaping during holding, transporting, and final disposal.

    (c)

    Vehicle and receptacle identification - Required. A solid waste collection vehicle and receptacle used for the collection of commercial, industrial, or institutional solid waste and placed at a commercial, industrial, or institutional establishment shall be identified with the name, trade name, and the city and state of its owner or operator.

    (d)

    Same - Details. The display of identification required by this section:

    (1)

    Shall be in letters in sharp color contrast to the background and shall be of a size, shape, and color as to be readily legible, during daylight hours, from a distance of 50 feet while the vehicle is not in motion; and

    (2)

    May be accomplished through the use of a removable device so prepared as to otherwise meet the identification and legibility requirements of this section.

    (e)

    Same - Compliance with other requirements. The provisions of subsections (c) and (d) of this section do not prohibit the display of any additional identification required by other laws of the state or of any other state or by any agency or department of the federal government.
