§ 12-3-205. DEAD, INJURED, OR STRAY ANIMALS ON PRIVATE PROPERTY.

  • (a)

    Exception. This section does not apply to horses.

    (b)

    Authority to pursue and take possession. The Health Officer may pursue and take into possession a dead, injured, or stray animal which is on private property in the county.

    (c)

    Immunity from prosecution. The Health Officer, the Animal Services Division, its agents, and employees are immune from prosecution for trespass arising from the performance of their duties under this section.
