§ 11-3-102. RECORDATION TAX.

  • (a)

    Required. A person shall pay the recordation tax imposed under this subtitle when the person:

    (1)

    Records an instrument of writing conveying title or an instrument of writing securing a debt with the Clerk of the Circuit Court for the county; or

    (2)

    Incurs additional debt secured by an instrument of writing conveying title or an instrument of writing securing a debt previously recorded.

    (b)

    Rate. In accordance with Title 12 of the Tax-Property Article of the Annotated Code of Maryland and the authority granted under § 11-1-102 of this article, the rates of tax applicable to instruments recorded with the Clerk of the Circuit Court for the county after June 30, 1981 are:

    (1)

    For an instrument of writing conveying title to property, $2.50 for each $500 or fraction of $500 of the consideration paid or to be paid; and

    (2)

    For an instrument of writing securing a debt, $2.50 for each $500 of the principal amount of the debt secured.
