§ 10-2-302. AUCTION BIDS.

  • (a)

    Authorized. Notwithstanding any other provision of law, auction bids may be used as a method for:

    (1)

    Procurement of commodities with an estimated contract value of $25,000 or less; or

    (2)

    Sale of personal property that has become obsolete and unusable with an estimated value of $5,000 or more.

    (b)

    Invitation and public notice.

    (1)

    Whenever the Purchasing Agent determines that it is in the best interest of the county for a procurement contract to be based on auction bids, an invitation for auction bids may be issued.

    (2)

    The method of public notice of an invitation for auction bids shall be the same as required for formal written contracts.

    (c)

    Determining successful bidder. Factors to be considered in determining the successful bidder shall be the same as for formal, written contracts under § 10-2-406(c) of this title.
